Résumé(s) : This thesis examines the legal and political implications of the Court of Justice of the European Union’s case law on the Common Foreign and Security Policy (CFSP). Although the Treaties formally restrict the Court’s jurisdiction in CFSP matters, the Court has progressively expanded its jurisdiction through a narrow reading of the carve-out and an extensive interpretation of the clawbacks. By analysing landmark judgment, from ECOWAS to KS and KD, the thesis shows how the Court has normalised the CFSP within the EU’s constitutional framework, altered the interinstitutional balance of power, strengthened fundamental rights through reasoning by implied hierarchy, and potentially produced ex-ante effects on sanctions policy and CSDP missions. The study highlights the gap between abundant legal commentary and the limited political analysis of these developments.
